Mother’s Rights

A mother’s bond with her children is special. The healthy development of a child hinges on the exercise of a mother’s legal parental rights and the parenting obligations of both parents. These are necessary to maintain prominent roles for mother and fathers. There is no presumption in the statute that favors one parent over the other. Instead the statute focuses on what has been the history of father and mother with respect to the children in caring for the children on a daily basis, taking the children to the doctor, interacting with the teachers, and involvement in the child’s activities. The statute also considers whether a parent has the capacity to take on these parental roles.
